What Type Of Compensation Claims Can I Make?

Suffering an injury that wasn’t your fault can cause long-term physical symptoms and psychological trauma and impact your ability to perform daily tasks. Making a compensation claim can cover the injury itself, including pain and suffering caused by your accident.

With so many claim types, knowing which you should be filing for is hard. Compensation claims can include accidents at work, medical negligence, road traffic accidents and injuries caused by poor maintenance of public or private premises.

Find out which compensation claim you can make.

Types of personal injury claims

When making a personal injury claim, knowing what you’re claiming compensation for is important. While some accidents might fall under the same claim, your case might differ. Here are some of the most common personal injury claims:

Road traffic accidents

Experiencing a road accident is relatively common in the UK, with the government reporting over 333,000 accidents in 2022 alone (GOV.UK). While most of these accidents will cause minor vehicle damage, some result in serious injuries.

From whiplash to fractures and head injuries, road users can file for compensation if someone else was negligent in their injuries.

Medical negligence

People go to healthcare professionals for treatment – not to suffer further injuries. Unfortunately, medical negligence cases cost the NHS over £2 billion, with obstetrics, A&E and orthopaedic departments seeing the highest number of complaints between 2022 and 2023 (Statista).

If you or a loved one received sub-standard treatment, you can file for medical negligence compensation and recover financial losses.

Accidents at work

The Health and Safety at Work Act lists employer responsibilities, including providing a safe workplace, offering adequate training and providing protective equipment. Unfortunately, some employers don’t take their commitment to employee safety seriously, resulting in injuries.

You can claim compensation for accidents at work as long as you prove that the employer was negligent.

Slips, trips and falls

Slips, trips, and falls are common personal injury compensation claims as they encompass a wide range of accidents. For example, slipping in a public place without a wet floor sign could count as negligence.

Local authorities can be held responsible if you are injured due to poorly maintained roads and pavements. Children are also at risk, with playground equipment causing cuts, scrapes and fractures from falls.

Criminal injuries

Nobody wants to be a victim of crime, but it can—and does—happen. These injuries often occur from random attacks or bar fights. However, dog bites also fall under the criminal injuries category, as owners are responsible for controlling their animals.

Victims of violent crime, including domestic abuse, have the right to file for personal injury damages and receive financial support. These cases often lead to psychological trauma, and your personal injury solicitor will factor this into the claim.

Claim Type Description Make Your Claim
Accidents At Work Accidents involving employer negligence, including injuries caused by poor training, a lack of PPE and unsafe environments.
Medical Negligence A missed diagnosis, incorrect treatment, surgical errors and injuries caused by malpractice.
Slips, Trips and Falls Accidents in public places or on privately owned land, including supermarkets, parks, playgrounds and on pavements.
Road Traffic Accidents Accidents caused by careless road users, including drunk driving, hitting pedestrians and speeding.
Personal Injury Claims Injuries caused by negligence. These claims often cause minor or major injuries, depending on the accident.
Sports Injury Claims Injuries caused by improper training, poorly maintained facilities and a lack of equipment.
Criminal Injury Claims Injuries caused due to criminal negligence. These claims can be due to bar fights, dog bites or random attacks.

Which types of compensation have the highest payout?

The compensation you receive depends on the extent of your injuries and their impact on your life. Long-term brain damage and physical disabilities are worth more due to the ongoing difficulties you’ll experience.

Which types of compensation have the lowest payout?

Minor injuries, such as cuts, scrapes or fractures that heal quickly, still pay compensation, but it’s not as much because you’ll recover fully.

What types of compensation have time limits?

Types of compensation with time limits include:

  • Personal Injury: General limit of three years from the date of injury or awareness of injury.
  • Accidents at Work: Three years, with extensions in exceptional circumstances.
  • Medical Negligence: Three years from the incident or awareness, with special rules for children and those with reduced mental capacity.
  • Traffic Accidents: Three years from the date of the accident.
  • Slips, Trips, and Falls: Generally three years, varies by injury impact.
  • Historical Exposure (e.g., Asbestos): Three years from diagnosis.
  • Criminal Injuries: Two years from the date of the incident.
